"A Primer on California's Bail Bonding Industry"

On Monday, December 11, 2000, the San Gabriel Valley and San Fernando Valley NCMA Chapters will conduct a joint meeting at Genio's Restaurant in Burbank.  We are pleased to announce that Mr. Frank Repetti will serve as the featured dinner speaker.   Mr. Repetti, the President and Chief Financial Officer of ebail, Inc., the Vice President of the California Bail Agents’ Association, and Parliamentarian of the Los Angeles Bail Agents’ Association, will present a Primer on California's Bail Bonding Industry.  Mr. Repetti acknowledges that public perception of the bail bond industry is largely derived from movies such as Midnight Run.  Mr. Repetti's presentation will break down some of these stereotypes, and will demonstrate that the bail bond industry operates from a sophisticated set of rules and business practices.  Mr. Repetti will present a brief history of the industry in California, followed by a discussion of recent industry developments.  Mr. Repetti also will entertain you with war stories concerning some of his most dangerous and hilarious experiences during his 18 years as a Bail Bondsman.  Mr. Repetti will advertise his December 11 Genio's appearance in Bail Agency publications, so we should get additional representation at our joint meeting from the bail industry as well.  It should be quite an evening.

Mr. Repetti is a recognized leader in California’s bail bonding industry.  Mr. Repetti entered the industry in 1983, when he went to work for Repetti Bail Bonds in Pasadena, California.  At Repetti Bail Bonds, Mr. Repetti worked with his father Frank Repetti Sr., who opened his Pasadena business in 1931.  Frank Repetti Jr. worked for Repetti Bail Bonds throughout high school and during his college years at Loyola Marymount University, where he graduated in  1989 with a Bachelor of Arts Degree in Urban Studies, focusing on Criminal Justice.  In 1992, Frank Jr. and his brother Paul purchased Repetti Bail Bonds from Frank Sr.

Frank’s rise in the industry has been rapid.  During the 1990s, Repetti Bail Bonds purchased competing bail agencies in Compton and Gardena, California.  The Repetti’s incorporated these three businesses in 1999, calling their bail conglomerate “ebail, Inc.”  The Repetti’s ebail, Inc. business utilizes state of the art technology which would make Bill Gates, let alone the bail competition, quite envious.  Frank Repetti’s success in the industry has not been limited to his own business.  In 1995, Frank was elected to the Board of Directors of the California Bail Agents’ Association, where Frank currently serves as the Vice President.  In 2000, Frank was elected Parliamentarian of the Los Angeles Bail Agents’ Association.

In Frank’s spare time, Frank and his brother Paul operate a web design and internet service provider business.  Frank is a sports fan, a reader of fiction and non-fiction works, and enjoys outdoor activity, including hiking and camping.  Most notably, Frank is an avid cyclist who has logged hundreds of miles in the Pacific Northwest and throughout Italy.  Frank married Noelle Hood in May 2000, and Frank and Noelle reside in the Silver Lake area.

MESSAGE FROM THE PRESIDENT

I want to thank all of you who attended our November 2000 dinner meeting.  Although I was unable to attend due to a trial in Washington D.C., I understand that the meeting proved to be productive and exciting.  I also want to personally extend my gratitude to our Treasurer, Pam Solis, who organized and ran an efficient and successful meeting.  Our featured dinner speaker, Mr. Thomas May of JPL, enlightened the chapter with his knowledge concerning marketing, sales, and recruitment, particularly of minority and women candidates.  Much to our surprise, Mr. May (on behalf of JPL) offered to support student participation in NCMA by subsidizing a portion of the students’ cost to attend our dinner meetings.  We also were fortunate to hear from Mr. Andrew Truong of Cal Poly Pomona, who described Cal Poly’s graduate MBA program which concentrates on contract management.  David Spencer, our acting Membership chair, congratulated and recognized long-term members of NCMA who were present at the meeting.  Gerald Cruce, our Seminars chair, discussed future meetings and seminar topics.  If you are interested in reading about these specific topics in more detail, you can review the minutes prepared by Veronica Serrano, which appear in this Newsletter.

 

I am very excited about our upcoming dinner meeting.  Mr. Frank Repetti, a principal of ebail, Inc., will serve as the guest dinner speaker.  This should be a special evening for many reasons.  First, Mr. Repetti will discuss one of the oldest contract-based industries in California, the bail bonding industry.  As we will learn, bail bondsmen, like contract managers, have to know and understand the contracting process and the Government regulations which govern it.  Second, the meeting will be a joint one with the San Fernando Valley chapter, which should allow us to see some old friends, and to network with some new ones.  Finally, Mr. Repetti will advertise his appearance in Bail Bonding publications, which should enhance our attendance even further.  I know Frank personally;  he is one hell of a guy and quite funny.  It should be quite an evening.

 

In closing, I hope to see all of you on December 11 at Genio’s in Burbank.  Of course, feel free to invite a spouse or a friend, arrive early to socialize, and don’t forget to RSVP to Paula Hockett.  Talk to you soon!

REGULATORY UPDATE:  November 13-22, 2000

I.          REGULATIONS

DoD issues notice of public meeting REGARding profit policy

The Department of Defense (“DoD”) is sponsoring a public meeting to discuss a proposed Defense Federal Acquisition Regulation Supplement (“DFARS”) rule on changes to profit policy.  As previously reported, the DoD proposed to amend the DFARS to alter the current profit policy for negotiated federal defense contracts.  (See Final Edition, September 2000 (discussing 65 Fed. Reg. 45574)).  The DoD uses weighted guidelines to determine target profit objectives for negotiated contracts.  The guidelines currently focus on performance risk, contract type risk, and facilities capital employed.  Based on a finding that as a result of defense industry downsizing and consolidation, the industry has excess capacity and underutilized facilities, the DoD has proposed to amend these guidelines to reduce, and eventually eliminate, facilities investment as a factor in establishing profit objectives on sole-source, negotiated contracts.  In its place, the DoD has proposed to increase the values for performance risk and decrease the values for contract type risk.  The proposed rule would also add general and administrative expenses to the cost base used to establish profit objectives.  The Director of Defense Procurement would like to hear the views of interested parties on what they believe to be the key issues pertaining to the proposed rule and potential alternatives.  The public meeting will be held on December 12, 2000.  (65 Fed. nasa issues final rule regarding risk management

The National Aeronautics and Space Administration (“NASA”) has issued a final rule to amend the NASA FAR Supplement (“NFS”) regarding risk management.  As previously reported, the NASA issued an interim rule regarding risk management.  (See Final Edition, August 2000 (discussing 65 Fed. Reg. 37057)).  This final rule adopts the interim rule without relevant changes.  The final rule accordingly amends the NFS to refocus on risk as a core acquisition concern by providing, among other things, the following:  (1) an emphasis, within the acquisition process, on risk management considerations such as safety, security, health, export control, and damage to the environment and (2) a consideration of risk management within the contexts of acquisition planning, selecting sources, choosing contract type, structuring award fee incentives, administering contracts, and conducting contractor surveillance.  Specifically, the final rule amends NFS Part 1807 (Acquisition Planning), Part 1815 (Contracting by Negotiation), Part 1816 (Types of Contracts), Part 1823 (Environment, Conservation, Occupational Safety, and Drug-Free Workplace), Part 1849 (Termination of Contracts), and Part 1852 (Solicitation Provisions and Contract Clauses).  The final rule became effective on November 22, 2000.  (65 Fed. Reg. 70315, 11/22/00)

doe proposes interim final rule to revise patent regulations relating to management and operating contracts

The Department of Energy (“DoE”) has issued an interim final rule to amend the Department of Energy Acquisition Regulation (“DEAR”) to improve patent coverage relating to management and operating (“M&O”) contracts.  The interim final rule establishes three patent rights clauses in DoE M&O contracts purportedly to better deal with the realities of performance under the contracts, to reflect additional statutory requirements and to address special treatment of exceptional circumstances in defense-related activities.  Accordingly, three new patent rights clauses are created:  one for nonprofit contractors, one for profit-making contractors where their contracts do not provide for technology transfer responsibilities, and one for large profit-making contractors where their contracts do provide for technology transfer activities.  In addition, the interim rule would effect, among other things, the following changes:  (1) adapt customary patent clauses to permit a contractor to request, and the DoE to authorize, the copying of copyrighted work; (2) limit the notice and assistance clause for subcontracts valued at $25,000 (the FAR limit for flowdown of this clause is the simplified acquisition threshold of $100,000); (3) establish a flowdown clause for patent indemnity; and (4) require the contractor to provide to the DoE information bearing on any royalty proposed to be paid after contract award.  This interim final rule will become effective Dec. 15, 2000.  Comments on the interim final rule should be submitted by Jan. 16, 2001.  (65 Fed. November 15 2000 Meeting Minutes

1.                   Meeting conveyed at 6:000 p.m.  Pam Solis announced that the December Dinner Meeting, a joint meeting with the San Fernando Valley Chapter, will be held December 11 in Burbank at Genio’s, and gave the address, time and cost of $20. The board agreed to discuss a subsidy for students. She stressed the need to R.S.V.P. for this meeting ASAP.

2.                   Pam announced that Mike Rizzo would be the guest speaker at the November 30th meeting at San Fernando Valley Chapter.

3.                   Stan Neves presented a brief overview of what was discussed at the Minneapolis Saint Paul Board of Director’s Meeting.  The subjects are as follows:

A.     The status of the Staff at the National Level.  They are looking for an Executive Vice President and a Controller.

B.     Cost Performance Report.

C.     Gralmann Awards-The San Gabriel Valley Chapter received third place.

4.                   Gerald Cruce discussed upcoming seminars.  There are 2 one-day seminars planned for the upcoming year.  The first seminar, on “Risk Management,” will be held on March 21, 2001.  The second seminar, on “Award‑Term Contacting,” will be held on May 16, 2001.  There will also be two workshops held next year.  One on Contractors Responsibility will be held in April 2001, and the second on Negotiations TBD.

5.                   Pam Solis gave the Treasurer’s Report for the months of September and October.

6.                   Dave Spencer congratulated and recognized the following Members by providing them with NCMA Pins for their length of membership.

7.                   John Wyatt presented an award to Stan Neves for his excellent leadership as president for the 1998-1999 and 1999-2000 terms.

8.                   Andrew Truong, Cal Poly Pomona, presented the Cal Poly University off campus MBA program.  He mentioned that it was rated number four in the Los Angeles area and provided brochures for those interested in the program.

9.                   Dinner Speaker, Thomas May, JPL, enlightened the Chapter with his knowledge and experience in marketing, sales and recruitment. He mentioned that JPL is a “Company of Choice” and it is the largest employer in San Gabriel Valley. His topic was recruitment of women and minority-owned businesses on government contracts, but quickly turned to a discussion toward the students on opportunities at JPL and the internship program they offer.

10.               Pam Solis thanked Mr. May for attending the dinner and providing such an enlightening topic. She announced that the chapter typically honors its guest speakers with a donation to CMI until this year. The chapter has opted to change the recipient to SLC and that a donation shall be made in his honor. In addition, a Certificate of Appreciation would be forthcoming.   Mr. May was delighted at the idea and thanked the chapter for having him as a guest speaker. He challenged the chapter to provide continued support to SLC students and announced that JPL will provide financial assistance to help the students offset the cost of future Chapter dinners. This was met with resounding applause by all!
